Understanding the New Biodiversity Law for Construction Projects

In a guide published in October 2024, Build Warranty Group explained the biodiversity net gain (BNG) requirement introduced under the Environment Act 2021. The article described it as a duty for most developments to leave nature in a measurably better state, with a gain of at least 10%, and said it was due to become mandatory in November 2023.
It outlined the process developers must follow. An ecological survey sets a baseline; the Defra Biodiversity Metric 4.0 then values the site by habitat type, condition and size; a plan sets out how the 10% uplift will be achieved, through measures such as tree planting, green space or off-site projects. Local planning authorities assess the plan as part of the planning decision, and those gains have to be looked after for a minimum of three decades.
Its advice to developers was to involve ecologists early, build in features like green roofs, wildlife corridors and natural water, and work with local authorities or conservation groups if on-site improvement is impractical. The firm said compliance can also strengthen a scheme's green credentials for buyers, and described itself as able to help with ecological assessments and long-term management plans.
